By using this site, you agree to the following terms and conditions regarding your use of the Youngstown State University (“YSU”) Support Services re:CREATE Program’s Mahoning Valley Exchange Website (“Website”). Violation of any of these terms is grounds to be excluded from use of the Website and its materials exchange. If you do not agree to these terms, please do not use this site.

LIMITATION OF LIABILITY
Under no circumstances shall re:CREATE and its partners, the State of Ohio, YSU, their employees, officers, trustees, agents or representatives be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from:

* The use of, or inability to use, this Website;

* The transfer, storage or disposal of materials pursuant to this Website;

* The disclosure of, or corruption, or erasure of, data transmitted or received or stored on any host server associated with this Website;

* The use of any other material or services provided, or promised to be provided; and

* Any other activities associated with the creation or use of this Website.

INDEMNIFICATION
You agree to defend, indemnify and hold harmless re:CREATE and its partners, the State of Ohio, YSU, their employees, officers, trustees, agents or representatives from all liabilities, claims, and expenses, including attorney’s fees, that arise from your use of this Website.

CHOICE OF LAW AND FORUM
This agreement shall be governed by and construed in accordance with the laws of the State of Ohio.

DISCLAIMER OF WARRANTIES
All materials and services included in or available through this Website are provided “as is” without warranties of any kind, either express or implied.

SEVERABILITY
If any part of this agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as best as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

This agreement may be changed without notice. The user agrees to be bound by the current version of this document.

TERMS OF USE

1. Mandatory reporting of materials exchanged: You must report an estimation of the weight and/or volume of materials(s) that you receive. (Website will have a link here to the report form) If an exchange of materials will be ongoing, you must report an estimation of the weight and/or volume of materials transferred each month. For infrequent transfers of materials, you must report an estimation of the weight and/or volume of materials exchanged after every transfer. If a material takes up a large volume but does not weigh much you should report it in volume and weight if possible. Report weight in pounds or tons, and volume in cubic yards. If you need help estimating the weight or volume of your material contact re:CREATE at seellis@ysu.edu or 330-941-2238.

2. When you make arrangements to take or give materials you are entering into an agreement. You are expected to take or give the specified amount of materials at the agreed upon date and time, this includes the transportation arrangements agreed upon. If you cannot keep your agreement you must inform the other party and re:CREATE immediately. You must make other arrangements that are suitable for the other party involved. Failure to keep your agreement, even once, can be grounds for exclusion from participation in this Website and its materials exchange.

3. This materials exchange is free. There is no charge to list a material that you have available or want. You cannot buy or sell materials on this site. You cannot charge for the transportation of a material or for its disposal. All materials must be exchanged free of charge.

4. It is the responsibility of the participants of this program to arrange for the transportation of the materials. re:CREATE and its partners are not responsible for transportation of materials.

5. re:CREATE and its partners are not responsible for the disposal of any materials acquired through this waste exchange. The eventual disposal of the items in this materials exchange is the responsibility of the material recipient. By taking the material, you agree to take responsibility for disposing of it in an environmentally safe way that meets all federal, state, and local laws.

6. It is the responsibility of the material donor and recipient to know and take all the necessary steps to comply with all federal, state, and local laws regarding the materials transferred, including laws regulating the safe transport, storage, and disposal of materials. re:CREATE and its partners are not responsible for any of the consequences of violating laws governing materials transferred through this materials exchange.

These terms of use help ensure the safe and efficient exchange of materials. Thank you for your cooperation and for conserving resources and landfill space by reusing.
